Aims and Objectives

The course consists of two parts which are relatively distinct, in spite of certain correlations. More specifically, we will look at both International and European aspects of Law, primarily from a social point of view.

 

 The main objective, in a 30 hour class, is to give the student the keys to solve the most common problems which they may run into as an employer called upon to manage the personnel of an association.

 

 In addition, by studying the social achievements of European Law, students can get an overview of the perspectives of an open market on associations in order to obtain a more social Europe.

Belgian Social Law : the law of 3 July, 1978 on the employment contract

 

  1. Statutes of personnel in a non-profit organisation which has a responsibility in the public service sector
  2. Statutes of personnel transferred from the public sector to the private sector in case of privatization of a public service
  3. Penal and civil responsibilities of the corporate body as employer
  4. Accidents at work
  5. Work Code

 

International Social Law : the International Labor Organization.

 

  1. The Treaty of Rome
  2. Multilateral and bilateral conventions

 

European Law :

  1. The European Institutions
  2. Regulations, directives, decisions and recommendations
  3. Social Europe : powers limited because left to the States’ national sovereignty, but a growing coordination in order to preserve the European social model,  European Social Fund activities
  4. Social challenges in Europe : services in Europe, the fight against social exclusion, non-European immigration, employment, worker’s rights in a company, the European Social Agreement, male-female equality, social security for migrant European workers, retirement.
